While we often refer to MH Legal Solutions as a legal consultation service to emphasize the nature of the partnership we hope to build with our clients, we are a law firm organized under Oklahoma law and run by a local, Oklahoma attorney.

MH Legal Solutions was born out of a belief that mental health treatment is often a life-changing experience. At the same time, running a mental health practice can be anxiety-inducing to put it mildly.

MH Legal Solutions arose from a desire to help mental health providers navigate murky legal waters at rates substantially less than what attorneys with similar experience might charge.

Our founder, Jason Kreth, is not only a licensed Oklahoma attorney with over 20 years of legal experience, but he is also a mental health provider with an active, regular caseload. Because of this, he understands the ins-and-outs of being a mental health provider and is able to provide a unique brand of legal expertise for other clinicians.

Like most attorneys, we charge on the basis of an hourly rate that is agreed to by us and our clients before services are ever performed. However, our goal is to provide services that are substantially less than the $350+ per hour you might be charged by other attorneys in the state with similar experience. We are able to do this by keeping our overhead as low as possible so so our rates can stay low as well.

In most cases we require the payment of a retainer which will be kept in a separate trust account and withdrawn to pay for our services as they are billed to you. In some instances, depending on the nature of the work provided, you may be asked to replenish that retainer as it runs out. If, at the conclusion of our services, some of that retainer remains, it will be promptly refunded to you.

MH Legal Solutions does not typically enter into “contingent fee” payment arrangements where the legal charges incurred are paid out of any litigation reward you receive.

This is a difficult question to answer regardless of the issue. MH Legal Solutions strives to provide individualized services tailored to each individual client’s needs. Because of this, and the variances that can exist within mental health practices, what may take 5 billable hours for one client could take 10 or more for another.

With that said, no one benefits from gotcha invoicing. At the outset of every matter, MH Legal Solutions strives to provide an estimated range of the potential cost that may be incurred by a client. While these estimates are subject to change as facts are developed and matters progress, we always want our clients to have reasonable expectations moving forward.

Clinicians have liability insurance for a reason and sometimes that insurance can provide legal representation free of charge. So why would you choose MH Legal Solutions instead of just contacting your provider? There are a few reasons.

First, by contacting your provider, you may be unintentionally raising your rates at your next renewal period. Insurance rates can and often do go up when a claim is initiated. Second, you often get little say in who represents you when the attorney is provided by your insurer. With MH Legal Solutions, you know exactly who you’re getting. Finally, an insurance provided attorney must balance not only your interests as a client, but those of the insurance company, as well. While, in theory, these interests should align, the truth is that this isn’t always the case. With MH Legal Solutions, you are our only concern.

Once you decide that MH Legal Solutions is the right fit for you, we will check your requested services against our current and former list of clients and matters to insure that no conflict of interest exists. If none show up, then you will be sent an engagement letter to review and execute that more particularly sets out the agreed-upon rates and terms of the attorney-client relationship.

Legal services are billed at hourly rates, typically in quarter-hour increments. Absent unusual circumstances, you will be billed monthly for charges incurred during the previous month. Payment is due within 10 days of the receipt of any invoice.

Jason Kreth has regularly provided seminars and classes on a number of legal topics and has authored articles and papers in both the legal and mental health fields.
